This policy explains what information Datawake ("we") collects through www.datawake.io (the "Site"), how we use it and the choices you have. It covers this website only. Information we handle for clients during a project is covered by our agreement with that client.
Who we are
Datawake runs the Site and is responsible for the personal information collected through it.
Information you give us
When you use the contact form, we collect what you enter:
- Name
- Email address
- Organization
- Phone number, if you choose to share it
- What you'd like help with, and your message
The same applies when you email or call us directly.
Information collected automatically
Like most websites, our hosting provider records basic technical information when you visit, such as your IP address, browser type, the pages you request and the time of the request. This is used to keep the Site running and secure.
We also use privacy-friendly analytics to count visits and see which pages are useful. These analytics don't use cookies and don't follow you to other websites.
Cookies
The Site doesn't use advertising, tracking or social media cookies. If that changes, we'll update this policy first.
How we use information
- To reply to your message and talk with you about working together
- To provide services you hire us for
- To understand how the Site is used and improve it
- To keep the Site secure and prevent abuse
- To meet legal obligations
We don't sell your personal information, and we don't share it for advertising.
Who we share it with
We share information only with the service providers that help us run the Site and our business, such as our website host, the service that delivers contact form messages, and our email provider. They may use it only to provide their service to us.
We may also disclose information if the law requires it, to protect our legal rights, or to a buyer if we ever sell the business.
How long we keep it
We keep contact form messages and email for as long as we need them to respond, to work with you and to maintain normal business records. You can ask us to delete your information at any time.
How we protect it
The Site uses encrypted connections (HTTPS), and access to messages is limited to the people who need it. No method of sending or storing information online is completely secure, so we can't guarantee absolute security.
Your rights
You can ask us to tell you what personal information we have about you, correct it, delete it, or stop using it. Email dustin@datawake.io and we'll respond within 30 days.
If you're in the European Union or the United Kingdom, you have these rights under the General Data Protection Regulation (GDPR), along with the right to data portability and the right to complain to your local data protection authority. Our legal basis for using your information is your consent when you contact us, and our legitimate interest in replying and running our business. California residents may have similar rights under California law, and we won't treat you differently for using them.
Children
The Site isn't meant for children under 16, and we don't knowingly collect their personal information. If you believe a child has sent us information, contact us and we'll delete it.
Do Not Track
We don't track visitors across other websites, so the Site works the same whether or not your browser sends a Do Not Track signal.
Links to other websites
The Site links to websites we don't control. Their own privacy policies apply when you visit them.
Changes to this policy
If we change this policy, we'll post the new version here and update the effective date above.
Terms and conditions
These terms apply to your use of www.datawake.io. By using the Site, you agree to them.
Content on the Site
The text, images, logos, designs and other materials on the Site belong to Datawake or are used with permission. You may share links to the Site and quote short passages with credit. Please don't copy or reuse larger parts without asking. Client names and logos belong to those organizations.
Information only
The Site describes our services in general terms. It isn't professional advice for your situation, and nothing on it creates a client relationship. Our work with clients is governed by a written agreement.
Links to other websites
The Site links to websites and services we don't own or control. We aren't responsible for their content, policies or practices.
No warranty
The Site is provided "as is." We work to keep it accurate and available but don't guarantee that it will always be either.
Limitation of liability
To the extent the law allows, Datawake and its owners, team members and affiliates won't be liable for any losses or damages arising from your use of the Site.
Indemnity
Except where the law doesn't allow it, you agree to hold Datawake harmless from claims, losses and expenses, including legal fees, that arise from your misuse of the Site or your violation of these terms.
Applicable law
These terms are governed by the laws of the State of California.
Dispute resolution
If a dispute can't be resolved through informal discussion, the parties agree to submit the issue to a non binding mediator, and to an arbitrator if mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both parties. The costs of mediation or arbitration will be shared equally. Each party keeps the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.
Severability
If any part of these terms is found invalid, that part is removed and the rest remain in effect.
Changes
We may update these terms from time to time. The new version applies once it's posted here.
